Sale or purchase of used machinery
In the case of purchase and sale of used or non-used machinery, paragraph 1 of Article 72 of Legislative Decree 81/2008 requires the certification of conformity of the machinery by the person selling it: Anyone who sells, rents or grants for use or financial leasing machines, apparatus or tools built or put into service outside the provisions of Article 70, paragraph 1, certifies, under his own responsibility, that the same comply, at the time of delivery to the person purchasing, receiving for use, rental or financial leasing, with the safety requirements set out in Annex V. SITUATION 1 Exchange of used machinery for new purchase According to art. 11, paragraph 1, of Presidential Decree 459/96 (still in force as required by art. 18 of Legislative Decree 17/10), the user (employer) who trades in a used machine for a new purchase must certify, at the time of sale, its compliance with the previous legislation. Art. 72 of Legislative Decree 81/08 supplemented this requirement by specifying that the certification concerns compliance with the safety requirements set out in Annex V. However, in the case of a "trade-in for a new purchase," there is no transfer to a direct user and, therefore, there is no intention to remarket a machine with any deficiencies. Based on these considerations, it is believed that the obligation to certify the machine's conformity falls to the reseller. Therefore, during the assessment, the reseller's compliance with this obligation will be verified. In the deed of sale, for used machinery and for machinery with possible safety deficiencies, it is advisable to specify: - machine type and model - serial number - manufacturer's name - wording "The machinery cannot be re-marketed in its current condition; this is only possible following compliance with safety standards." SITUATION 2 Sale of used machinery to another direct user The owner of a machine (e.g., the employer) who sells it to a direct user (e.g., another employer) must always certify the machinery's compliance with the safety requirements set out in Annex V. This obligation also applies to anyone who lends the machinery, rents it, or provides it on loan. SITUATION 3 Sale of used machinery for sale The owner of a machine, who supplies it to a third party with a power of attorney for the sale of the asset, is required at the time of sale to certify the machine's conformity to the safety requirements set out in Annex V. In the case of exchanging the machine for a new purchase (or transferring it to a party who will not put it into service, but will put it back on the market after having reconditioned it), the aforementioned document allows the seller not to certify the machine's conformity, shifting this obligation to the time the reconditioned machine is put back on the market, while the ministerial circular requires that in any case the seller certify that the machine complies with the previous legislation. TECHNICAL NOTES: On this subject, ruling of the Criminal Cassation Court, Section III, of 1 October 2013, no. 40590 specifies that the manufacturer is not liable if it sells a machine that lacks the necessary safety requirements if it is not to be used subsequently, but only to be repaired and overhauled before being placed on the market: "If the sale of the non-compliant machinery is made with the sole intention of not putting it into circulation but of entrusting it to a party (the transferee) for repair, the regulatory provision can no longer be applied." Indeed, the contested provision is based on a principle of reasonableness, not divorced from a general economic rule, in the sense that, while the use of non-compliant machinery is prohibited, the sale of such products is, as a rule, prohibited given the consequent and normal use of the machinery in the production cycle, with a view to the industrial product's transition to the next economic phase (use). Where this latter transition does not exist (as in the case of machinery being stored at a company specializing exclusively in repairs for compliance with regulations, with well-specified tasks that preclude subsequent use mediated through the original seller), the sale of machinery cannot be considered prohibited because it has a well-defined purpose, without any foreseen use.
